Jim Berg is a member of PIB Law. Jim has extensive experience with issues arising within the mortgage industry including originations, core and default servicing, mortgage fraud, credit reporting, unfair and deceptive trade practices, property preservation and REO issues. His practice concentrates on defending financial institutions in consumer class actions, retail financial services litigation, mediations and arbitrations at all levels of federal and state courts. Jim also conducts internal investigations involving state consumer protection act statutes, the Servicemembers Civil Relief Act (“SCRA”), foreclosure, bankruptcy and loss mitigation issues. He provides counsel in all aspects of regulatory enforcement inquiries emanating from subpoenas, civil investigative demands, requests for information and cease and desist orders.
Prior to joining the Firm, Jim served as in-house counsel at JPMorgan Chase Bank, N.A., where he supervised outside counsel in hundreds of cases involving all aspects of mortgage-related litigation. He has managed significant class action litigation and regulatory matters involving the SCRA, False Claims Act, Fair Credit Reporting Act, Fair Debt Collection Practices Act and bankruptcy and state consumer protection statutes. Jim routinely advised senior management on investigations and proceedings predicated upon inquiries from the Department of Justice, HUD, and various state attorneys general. In addition, Jim supervised attorneys and advised project teams in implementing operational controls to ensure compliance with applicable federal and state laws including the U.S. Bankruptcy Code and SCRA.
Prior to serving as in-house counsel, Jim was associated with McCarter & English LLP, and prior to that, with Lowenstein Sandler PC, where he litigated matters involving banking and finance, commercial law, collections, insurance, contracts, and bankruptcy. He also clerked for the Honorable R. Benjamin Cohen, Presiding Judge of the Chancery Division, General Equity.
Jim received his J.D. from Rutgers School of Law - Newark and his B.S. from Rutgers College. He is admitted to practice in New Jersey, New York and the District of Columbia.
