New York’s Appellate Division, Fourth Department Expands Its Operations as a Virtual Court Print PDF

On April 17, 2020, the Fourth Department announced that, as with other courts throughout New York, it has started to operate as a virtual court. Most significantly, as set forth in its announcement, the Court has rescinded its prior order suspending deadlines to perfect and file appeals.
- Appeals and Motions: The Court re-calendared all matters previously scheduled for the May 2020 term to the June 2020 term, scheduled for June 22 through July 2, 2020. Any oral argument for the June 2020 term shall be conducted via videoconference or teleconference. The Court rescinded its March 17, 2020 order suspending most deadlines for perfection and filing, and set forth new deadlines in an April 17, 2020 Order. The Court also stated that “filing of hard copy records, appendices, briefs and motions is once again permitted as directed or required by order, rule, or statute.”
- Admissions: The Court is processing attorney admission applications. If necessary, candidates for admission will be interviewed virtually. The Court also plans to hold two virtual admission ceremonies on June 15, 2020.
